论建立我国道路危险货物运输豁免管理标准

摘要: 为填补我国道路危险货物运输豁免标准的空白,对我国现有道路危险货物运输法律法规制定过程进行了分析和归纳,并首次将其按时间顺序划分为3个阶段:解放初期至上世纪80年代中期的初级管理阶段;上世纪80年代中期到2000年的规范阶段以及从2000年开始至今的完善管理阶段。在此基础上,分析了建立我国道路危险货物运输豁免标准的必要性和迫切性,同时结合国外相关经验,提出了豁免标准建立的原则及内容,对建立适合我国国情的道路危险货物运输豁免制度具有重要参考价值和现实意义。

Abstract: In order to fill the gaps of the road transport exemption of dangerous goods in China, the policy-making processes of the dangerous goods transportation are analyzed and classified, which are firstly divided into three stages: the primary management stage from the initial liberation to the Mid-1980s, the standardize management from the Mid-1980s to the year of 2000, as well as the improvement management stage from the year of 2000 to present, respectively. Then, the necessities and urgencies of the establishment of transport exemption standards of dangerous goods in China are detail put forward. Finally, combing with the relevant foreign experiences, the exemption’s principles and contents are firstly proposed, which is helpful to draw up the transportation exemption of dangerous goods of Chinese Characteristics.
